Terms of Service

These Terms of Service ("Terms") govern your use of the Marque application and website at marque.app ("Service"), operated by Marque ("we", "us", "our"). By using the Service, you agree to these Terms.

1. The Service

Marque is a personal writing voice engine. It learns your writing style from your sent emails and generates text that matches your voice. The Service includes:

• Email account connection and voice model training
• Text generation using your personal voice model
• Voice profile management
• Related tools and features (browser extension, API access, where available)

2. Account Registration

To use Marque, you must create an account. You agree to:

• Provide accurate information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

You must be at least 16 years old to use the Service.

3. Email Access and Consent

When you connect your email account, you grant us permission to:

• Access and read your sent email messages (sent folder only)
• Process the text content of those messages to train your voice model
• Store processed training data as described in our Privacy Policy

You represent that:

• You have the right to grant this access
• The email account belongs to you
• You understand that sent emails may contain information about other people, and you accept responsibility for granting access to this content

You may revoke email access at any time through your account settings.

4. Your Voice Model

Your voice model is a fine-tuned language model adapter trained on your writing patterns. You should understand that:

• The voice model is a statistical representation of your writing style — it does not store or reproduce your emails
• Generated text may not perfectly match your writing in all contexts
• The quality of generated text depends on the quantity and variety of your sent emails
• Your voice model is private to your account and is not shared with other users

5. Generated Content

You own the text generated by Marque using your voice model. However:

• You are responsible for reviewing generated text before sending or publishing it
• Marque does not guarantee that generated text is accurate, appropriate, or error-free
• You should not rely on generated text for legal, medical, financial, or other professional advice
• You are solely responsible for how you use generated text

6. Acceptable Use

You agree not to use the Service to:

• Generate spam, phishing messages, or fraudulent content
• Impersonate others or create misleading communications
• Generate content that is illegal, harassing, threatening, or harmful
• Attempt to extract or reverse-engineer other users' voice models
• Interfere with the Service's operation or security
• Exceed rate limits or abuse the Service in ways that degrade it for others
• Use the Service in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms.

7. Pricing and Payment

Marque offers free and paid tiers. For paid subscriptions:

• Prices are displayed before purchase and may change with notice
• Subscriptions renew automatically unless cancelled
• You can cancel at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you acknowledge and agree to the practices described in the Privacy Policy.

10. Intellectual Property

The Marque name, logo, website design, and underlying technology are our property. You may not copy, modify, distribute, or create derivative works based on our Service without permission.

You retain ownership of your email content and generated text. We claim no ownership of your data.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
• We are not responsible for the content of generated text or how you choose to use it

12. Account Termination

You may delete your account at any time. When you delete your account:

• Your voice model is permanently deleted
• Your training data is permanently deleted
• Your generation history is permanently deleted
• Your OAuth tokens are revoked and deleted
• This process is irreversible

We may terminate or suspend your account if you violate these Terms, with notice where practicable.

13. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Marque is incorporated. Any disputes will be resolved through binding arbitration or in the courts of that jurisdiction.
